Claim procedure

Your rights and obligations concerning the liability of the Seller for the defects, including the warranty liability, shall be governed by relevant generally binding legal regulations, particularly the provisions of Section (§) 2158 et seq. of the Act No. 89/2012 Coll., the Civil Code.

We provide a warranty on the goods for the period of 24 months unless stated otherwise on the goods or in the warranty card.

In the case of a claim, follow the following procedure:

  • the claim shall be made within the warranty period and without unnecessary delay, i.e. within the shortest time after the defect has been discovered
  • the goods must be accompanied by the supporting document proving receipt of the goods; the goods themselves must be complete, cleaned, devoid of any stains and hygienically unobjectionable. The Seller is entitled to refuse to accept the goods, for the claim procedure, that are not compliant with the abovementioned standards
  • mark the claimed defect of the goods
  • make the claim by sending the goods accompanied by the relevant documentation to the address pietro filipi, Kolbenova 609, 190 00 Praha 9

The Seller shall decide on the claim, without unnecessary delay. The claim, including defect removal, must be dealt with without unnecessary delay, no later than within 30 days from the moment the claim was made unless the Seller and the Buyer agree on a longer period.

The defects are divided according to whether the defective performance constitutes a substantial or a minor breach of the Contract. The Buyer's rights differ based on the nature of the defect:

a) Provided the defective performance constitutes a substantial breach of the Contract, the Buyer is entitled to: removal of the defect by delivery of new defect-free goods or by delivery of missing goods, or removal of the defect by repairing the goods, or an adequate discount from the purchase price or withdrawal from the Contract.

b) Provided the defective performance constitutes a minor breach of contract, the Buyer is entitled to defect removal or an adequate discount from the purchase price.

Please bear in mind that the warranty period and textile product lifespan are two different notions. The lifespan is determined by the manner and intensity of use and does not always have to correspond with the warranty period. That means that, with intensive use, the lifespan of textile products may be shorter than the warranty period.
